Terms and conditions of sale

These terms apply to everything sold through dtcrompton.com by Daniel Crompton, a sole trader based in North Yorkshire, United Kingdom ("I", "me"). By placing an order you agree to them. Please read them, and save a copy; nothing in them affects your statutory rights as a consumer.

1. The contract between us

Placing an order is an offer to buy. I will acknowledge your order by email, but a contract is formed only when I confirm that your order has been dispatched. If I cannot fulfil an order, for example because an edition sells out at the same moment or an item cannot be produced to standard, I will tell you and refund any payment in full.

2. The prints

Prints are limited editions, made to order, then signed, numbered and certified by hand. Because each is hand-finished, small variations are normal and are part of their character. Colours may also appear differently between screens and the finished print. Edition sizes and the number remaining are shown on each piece.

3. Price and payment

Prices are in pounds sterling and are shown on each piece. I am not currently VAT registered, so no VAT is added. Some editions are priced dynamically, so the price rises as the edition sells; the price shown at checkout is the price you pay. Payment is taken at checkout through Stripe. Ownership of a print passes to you once payment has cleared in full.

4. Delivery and risk

Delivery is covered in the shipping policy. Delivery times are estimates and are not guaranteed. Responsibility for the goods passes to you when they are delivered to the address provided by you at checkout.

5. Cancellation

Under the Consumer Contracts Regulations 2013, the usual fourteen-day right to change your mind does not apply to goods that are made to order or clearly personalised. As every print is produced, signed and numbered specifically for you once you order, it falls within that exemption, and orders cannot be cancelled for a change of mind once production has begun. This does not affect your rights where an item is faulty or not as described.

6. Faulty or misdescribed items

Under the Consumer Rights Act 2015, everything I sell must be as described, of satisfactory quality and fit for purpose. If an item is faulty or not as described, you have the right to reject it for a refund within thirty days of delivery, or to ask for a replacement. 7. Digital and on-chain works

Where digital or blockchain-based works are offered, you receive the work or token described. The blockchains, wallets and marketplaces involved are run by third parties and are outside my control, and the value of any token may go down as well as up. Nothing on this site is financial advice, and I make no promise about resale value.

8. Intellectual property

All artwork, code, text and images on this site remain my property and are protected by copyright. Buying a print or a token gives you that item for your own personal enjoyment; it does not transfer copyright or any right to reproduce, resell commercially, or make derivative works from the art.

9. Using this website

You may use the site for browsing and buying. You may not misuse it, attempt to disrupt it, or scrape or copy its content for commercial use without permission.

10. My liability

Nothing in these terms limits my liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited by law, including your statutory consumer rights. Subject to that, my liability for any order is limited to the price you paid for it, and I am not liable for losses that were not foreseeable or that do not flow directly from a breach of these terms.

11. Events outside my control

I am not responsible for delays or failures caused by events beyond my reasonable control, such as postal disruption, supplier failure or extreme weather. If such an event occurs, I will contact you and, where a significant delay results, you may cancel the affected order for a refund of anything not yet delivered.

12. Law and disputes

These terms are governed by the law of England and Wales, and disputes may be brought before its courts. If you live outside the UK you keep the mandatory protections of your own nation's law. I will always try to resolve any problem with you directly first.

13. Changes

I may update these terms from time to time. The version that applies to your order is the one published when you placed it.
